1. Acceptance of Terms

By accessing, using, or registering for PetLog ("the Service"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations of India. If you do not agree with any part of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and PetLog ("we," "us," or "our") and are governed by the laws of India. By clicking "I agree," creating an account, or using the Service in any manner, you represent and warrant that:

• You are located in India and are using this service from within India
• You have the legal capacity to enter into this agreement under Indian law
• You accept all terms and conditions contained herein
• You understand that these Terms are governed by Indian law

IMPORTANT: By using PetLog, you expressly agree that you will not, under any circumstances, bring any claim, lawsuit, or legal action against PetLog, its owners, operators, employees, agents, affiliates, or service providers for any reason whatsoever, including but not limited to data loss, service interruptions, errors, omissions, or any other issues related to the Service. You acknowledge that your use of the Service is entirely at your own risk and that you have no right to seek damages, injunctive relief, or any other legal remedy against us.

2. Description of Service

PetLog is a cloud-based pet care management platform designed for users in India. The Service allows users to record, store, and manage information about their pets, including medical records, vaccination schedules, medication plans, event logs, and related data. The Service is provided "as is" and "as available" without any warranties or guarantees of any kind.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, for any reason or no reason. We do not guarantee that the Service will be available at all times, uninterrupted, secure, or error-free. The Service is not designed, tested, or intended for use outside of India.

3. User Accounts and Responsibilities

3.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 User Responsibilities

You agree to:

• Provide accurate, truthful, and complete information when creating and maintaining your account
• Maintain the security of your account credentials and immediately notify us of any unauthorized access
• Use the Service only for lawful purposes and in accordance with these Terms
• Not share your account credentials with any third party
• Not use the Service to violate any applicable laws, regulations, or third-party rights
• Not attempt to gain unauthorized access to the Service or any related systems or networks
• Not interfere with or disrupt the Service or servers connected to the Service
• Not use automated systems (bots, scrapers, etc.) to access the Service without our express written permission
• Not upload, post, or transmit any content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Accept full responsibility for all data you enter into the Service and acknowledge that you are solely responsible for verifying the accuracy of such data

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice, if we determine that you have violated these Terms or engaged in any conduct that we deem harmful to the Service or other users.

4. Data Usage, Ownership, and Storage

4.1 Data Ownership

You retain ownership of the data you upload to the Service. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, process, and display your data solely for the purpose of providing the Service to you.

4.2 Data Usage

We commit to using your data only for the following purposes:

• Providing, maintaining, and improving the Service
• Processing your requests and transactions
• Sending you service-related communications and notifications
• Ensuring the security and integrity of the Service
• Complying with legal obligations

We do not sell your data to third parties. We do not use your data for advertising purposes. We do not share your data with third parties except as necessary to provide the Service (e.g., cloud hosting providers) or as required by law.

4.3 Data Storage and Backup

While we implement reasonable security measures and backup procedures, you acknowledge and agree that:

• We are not responsible for any loss, corruption, or deletion of your data
• You are solely responsible for maintaining your own backups of important data
• We do not guarantee that your data will be recoverable in the event of a system failure, security breach, or other incident
• We may delete your data if your account is terminated or inactive for an extended period

5. Medical and Veterinary Information Disclaimer

CRITICAL DISCLAIMER: PetLog is a data management tool only. It is NOT a substitute for professional veterinary care, medical advice, or treatment. The Service does not provide medical, veterinary, or health advice of any kind.

You acknowledge and agree that:

• All medical information, medication schedules, vaccination records, and health data stored in PetLog are for informational and record-keeping purposes only
• You must consult with a licensed veterinarian for all medical decisions regarding your pets
• We are not responsible for any medical decisions made based on information stored in or retrieved from the Service
• We do not verify, validate, or guarantee the accuracy of any medical or health information you enter into the Service
• We are not liable for any adverse health outcomes, injuries, or deaths that may occur to your pets, regardless of whether such outcomes are related to information stored in the Service
• You are solely responsible for ensuring that all medical information is accurate and up-to-date
• You are solely responsible for following up with veterinarians and ensuring proper medical care for your pets

By using PetLog, you expressly waive any and all claims against us related to medical decisions, veterinary care, pet health outcomes, or any consequences arising from the use or misuse of medical information stored in the Service.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PETLOG, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AFFILIATES, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, profits, revenue, business opportunities, or goodwill
• Costs of procurement of substitute services
• Personal injury or property damage
• Pet injury, illness, or death
• Medical expenses or veterinary bills
• Emotional distress or mental anguish
• Any other damages arising out of or in connection with your use of or inability to use the Service

This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or relating to the Service exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater. If you have not paid us anything, our total liability shall not exceed one dollar ($1.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. However, to the maximum extent permitted by law, you agree that these limitations represent a reasonable allocation of risk and are an essential basis of the bargain between us.

7. Indemnification

You agree to defend, indemnify, and hold harmless PetLog, its owners, operators, employees, agents, affiliates, service providers, and licensors from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights, including intellectual property rights, privacy rights, or other proprietary rights
• Any content or data you upload, post, or transmit through the Service
• Any medical decisions or actions taken based on information stored in the Service
• Any claims brought by third parties (including other users, veterinarians, shelters, or pet parents) arising from your use of the Service

This indemnification obligation will survive the termination of these Terms and your use of the Service.

8. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Warranties of fitness for a particular purpose
• Warranties of non-infringement
• Warranties of accuracy, completeness, or reliability
• Warranties that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components
• Warranties that defects will be corrected
• Warranties regarding the security, privacy, or confidentiality of your data

We disclaim all warranties, express or implied, to the maximum extent permitted by applicable law. You acknowledge that you use the Service at your own risk and that we make no representations or warranties regarding the Service's suitability for your particular needs.

9. Release and Waiver of Claims

BY USING PETLOG, YOU HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE PETLOG, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, LIABILITIES, DAMAGES, COSTS, AND EXPENSES (INCLUDING ATTORNEYS' FEES) OF ANY KIND OR NATURE, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, ARISING OUT OF OR IN ANY WAY RELATED TO:

• Your use of the Service
• Any errors, omissions, or inaccuracies in the Service or your data
• Any interruption, suspension, or termination of the Service
• Any loss, corruption, or deletion of your data
• Any security breaches, unauthorized access, or data breaches
• Any medical decisions, veterinary care, or pet health outcomes
• Any interactions with other users, veterinarians, shelters, or third parties through the Service
• Any reliance on information stored in or retrieved from the Service
• Any technical failures, bugs, or malfunctions
• Any other matter related to the Service

You acknowledge that you understand the significance of this release and waiver and that you are voluntarily waiving rights that you may otherwise have. This release and waiver apply to all claims, whether based on contract, tort, negligence, strict liability, or any other legal theory.

10. No Right to Sue

YOU EXPRESSLY AGREE THAT YOU WILL NOT, UNDER ANY CIRCUMSTANCES, BRING ANY CLAIM, LAWSUIT, LEGAL ACTION, ARBITRATION, OR OTHER PROCEEDING AGAINST PETLOG, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AFFILIATES, SERVICE PROVIDERS, OR LICENSORS FOR ANY REASON WHATSOEVER.

This includes, but is not limited to:

• Claims for damages, whether direct, indirect, incidental, consequential, or punitive
• Claims for injunctive relief or specific performance
• Claims for breach of contract, negligence, fraud, misrepresentation, or any other legal theory
• Claims related to data loss, data corruption, or data breaches
• Claims related to service interruptions, downtime, or unavailability
• Claims related to medical decisions, veterinary care, or pet health outcomes
• Claims related to interactions with other users or third parties
• Claims related to intellectual property rights
• Claims related to privacy or data protection
• Any other claims of any kind or nature

By using the Service, you acknowledge that you have read and understood this provision and that you voluntarily and knowingly waive your right to bring any legal action against us. If you do not agree to this provision, you must not use the Service.

11. Intellectual Property

The Service, including its design, features, functionality, content, and all intellectual property rights therein, are owned by PetLog or its licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

You retain ownership of the data you upload to the Service, but you grant us a license to use such data as described in Section 4.1.

12. Third-Party Services

The Service may integrate with or link to third-party services, websites, or applications. We are not responsible for the content, privacy practices, or terms of service of any third-party services. Your use of third-party services is subject to their respective terms and conditions.

We use third-party service providers (such as Supabase for database services and Vercel for hosting) to operate the Service. While we select reputable service providers, we are not responsible for any failures, errors, or issues caused by these third-party services.

13. Dispute Resolution

If any dispute arises out of or relates to these Terms or the Service, you agree to first contact us to attempt to resolve the dispute informally. If we cannot resolve the dispute within sixty (60) days, you agree that any dispute shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015 of India, except that you waive any right to a jury trial and any right to participate in a class action lawsuit. The arbitration shall be conducted in India and in the English language.

Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights or to prevent unauthorized use of the Service.

14. Termination

We may terminate or suspend your access to the Service at any time, with or without cause or notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or using account deletion features in the Service. Upon termination, we may delete your account and associated data, subject to our data retention policies as described in our Privacy Policy.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the Service and may terminate your account as described in Section 14.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PetLog regarding the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts located in India, and you hereby consent to the personal jurisdiction of such courts.

If you are accessing this service from outside India, you acknowledge and agree that:

• These Terms are governed by Indian law regardless of your location
• Any disputes will be resolved exclusively in Indian courts
• You may not have the same legal protections available in your jurisdiction
• You waive any right to claim that Indian law does not apply to these Terms
• You waive any right to bring proceedings in any jurisdiction other than India

By using the Service, you expressly agree to submit to the exclusive jurisdiction of the courts of India for any disputes arising out of or relating to these Terms or the Service.

BY USING PETLOG, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE, INCLUDING ALL DISCLAIMERS, LIMITATIONS OF LIABILITY, RELEASES, WAIVERS, AND PROVISIONS THAT LIMIT YOUR RIGHT TO SUE. YOU UNDERSTAND THAT THESE TERMS ARE LEGALLY BINDING AND THAT YOUR USE OF THE SERVICE CONSTITUTES YOUR ACCEPTANCE OF ALL TERMS AND CONDITIONS CONTAINED HEREIN.

If you do not agree to any part of these Terms, you must immediately stop using the Service and may not create an account or access any features of the Service.
